NCPTA Rejects MoE and GES Guidelines for PTAs, Citing Lack of Legal Backing

The National Council of Parent-Teacher Associations (NCPTA) has strongly rejected the new guidelines issued by the Ministry of Education (MoE) and the Ghana Education Service (GES) for the operations of Parent-Teacher Associations (PTAs), describing the move as unlawful and outside the statutory mandate of the two state institutions.

In a press statement dated September 30, 2025, and signed by the NCPTA General Secretary, Mr. Gapson Kofi Raphael, the Council maintained that neither the 1992 Constitution nor the Pre-Tertiary Education Act, 2020 (Act 1049), grants MoE or GES powers to regulate the internal affairs of PTAs.

According to the statement, PTAs are voluntary, non-statutory bodies legally registered under the Companies Act, 2019 (Act 992), and therefore operate strictly within the framework of their constitutions and registration guidelines. The NCPTA stressed that their establishment, governance, and activities are not subject to control by MoE or GES.

The Council argued that any attempt by MoE and GES to enforce such guidelines would amount to an “ultra vires exercise of power,” as no public body is permitted to act beyond the authority granted it by law. The NCPTA emphasized that regulations without a clear statutory foundation are null and void.

The statement, endorsed by the NCPTA’s national, regional, district, and school-based leadership, represents what it described as a “total national consensus and outright rejection” of the purported guidelines.

The NCPTA cautioned government to avoid overstepping into PTA affairs, warning that such actions could undermine public trust and risk political backlash, similar to the discontent witnessed in 2024.

It concluded with a call on the Ministry of Education and the Ghana Education Service to respect the law and refrain from interfering in matters beyond their jurisdiction.
